Over the past year, Summit REALTORS® (SAR) has received numerous inquiries from its REALTOR® members, property owners, homeowner associations, and other organizations about whether there is a legal cause of action against the Town of Breckenridge over its recent passage of an Ordinance that further regulates short-term rentals in the Town of Breckenridge.
In response to this concern, SAR has retained the law firms of Knapp & Associates and Holland & Knight, who are collaborating to analyze the Town’s Short-Term Rental Ordinance. To support our members and real estate owners, SAR will use the legal research to further our advocacy goals. We are seeking to understand the legality of the new ordinance. SAR has obtained legal analysis several times over the past 15 years to review local ordinances for advocacy purposes.
Further, SAR and a number of its members have been alerted to the fact there are several parties interested in exploring legal action. While the Association does not have any plans to be involved in any litigation in this matter, we are committed to providing referral information to the law firms upon completing their study.
